If you plan on commissioning me or purchasing/owning one of my designs, please read this!
◈ General Information & Rights ◈
You, as a commissioner, are responsible for reading, reviewing, and understanding my terms of service. If there is any confusion, you're more than free to ask if something isn't clear, and I heavily encourage this if there is! This, as well, extends to questions about your commission and the progress at any point in time: I'll be happy to answer any and will be more than willing to share work-in-progress shots if it is so desired.Generally, I work to be as efficient as I can be with my commissions. If you are in any way unhappy with your finished product, I'd be happy to fix the commission where I can, and possibly even provide a second, redone piece within reason. This does not give anyone the right to take advantage of this possibility and only if we can come to an agreement together will I agree on the latter option. However, as I strongly try to offer artwork that meets or goes beyond the commissioner's expectation, I have high hopes this won't happen (if only very rarely, if that)!I will communicate to keep you, the commissioner, informed if anything impacts my ability to get your commission done - if it is an extreme case, or if I feel I will not be able to finish the art, I will offer a refund or a subject change if either is so desired.I will not sell or provide commissions to empty accounts or accounts younger than two months for my own comfort.I retain the right to deny a commission for any reason.I retain the rights to my work, commissioned or otherwise, unless explicitly stated by myself. The characters I depict may not be mine, but the art is, and I should be credited for the artwork clearly if it's exhibited anywhere.NEW
Nothing made/created by myself, the artist, may be used in any blockchain-related technology, to include NFTs, cryptocurrency, or future inventions in the space. To add on to this, any commercial use is forbidden unless I, as the artist, specifically state otherwise.
◈ Payment Terms ◈
I accept payment as USD on PayPal first and foremost. Generally, I will be very understanding if you're needing a wait time in order to have the money and let you hold a spot - but for no longer than two weeks. I normally send out PayPal invoices to keep track of my commissions. I will withhold the art if payment isn't received by the time I finish with the commission until it is paid for and if after a month (at the latest) there is no payment, I have the right to reuse the art. If communication keeps up and you have a genuine reason for not being able to pay, these terms may sway: but only if I am allowed to understand your situation. Communication is key! Please never be afraid to use it.If at any time there is a charge back or cancellation without any form of communication, I reserve the right to blacklist you from future commissions, adoptables, etc.
◈ Work Schedule ◈
I work as a freelance artist beside a full time education. My schedule changes from month to month on when I'll be working so my process may waver: however, again, when I am at my computer I am most certainly chipping away at art as much as I can manage. And, again, I will of course keep you informed if something impacts my ability to finish or otherwise hinder my process with your commission, and we will go from there if any steps need to be made.
◈ Process ◈
Once we get the details down (and these details can be as specific or as vague and simple as you'd like them to be when describing what you'd like), I will send you a sketch on my idea of what you want from me. This is when most of the changes happen: if I'll need to fix or add any details. If the sketch is good as is, then I will ask for payment; if not, I will revise the sketch and send it again until you are content with it and I will ask for payment then. In special cases, such as Your Character Here's, I will ask for payment up front as the sketch is already there and add in the details you wish to be added into it as I proceed.You may state early on if you'd like a work in progress at any specific points, or as many as possible; I am more than happy to oblige!I am happy to make smaller changes even during the finalization of the artwork. I do not accepted large, near-complete revision changes after the sketch stage. After it is finalized and the art is given to you, I will make no other major changes. (You may inquire about this as I'm usually very willing to do small changes or edits to the art if I believe it is in my power or ability to do so after it's completed. It never hurts to ask!)I normally keep my files for very long after a completed commission, however it is up to you, the commissioner, to save these files to keep them as I may not have them at a later date.
◈ Shipping ◈
At current I will not be shipping any items and any pending shipments or otherwise that may be prompted by PayPal are in fact digital goods rather than physical; you, as the commissioner, understand this.
◈ Final Product ◈
I, as the artist, hold no responsibility nor liability for what the client or third parties edit or do with the artwork once the artwork is completed. Basically: I do not need to fix corrections or errors that were made by the client or third party. I hold no responsibility for the adjustment, as it wasn't made by myself. That being said, I do not allow edits to my work without my approval on said possible changes or edits.You may upload your commissioned art elsewhere, so long as the credit remains. You may not sell my artwork under any circumstance unless otherwise stated by myself.
◈ Cancellation ◈
In the case of serious emergencies or problems likened to that severity, I will always offer a refund to you if I feel I am unable to complete the commission for whatever reason. If you need to cancel a commission because of an emergency, I will offer a full refund so long as the commission has not passed the finalization stage. I retain the right to reuse the sketch of the cancelled commission, however.
◈ Designs & Adoptables
Adoptables and designs that you buy from me may be sold for however much; I'm loosening my stringency on this by preference alone. Still, however, please, please never hesitate come to me if you desire a price estimate on an adoptable or design, should you be looking to resell them and wanting to know the amount they were sold for. I absolutely do not mind if they are traded or given away!In the process of auctions or 'offer to adopt's, any misconduct (bullying, manipulating, etc.) towards other potential/interested buyers will result in a blacklist. Under no circumstance are designs that are given away for free (via raffle or otherwise) are allowed to be sold or given away, and must be returned to me (Silverfang) if looking to rehome. Patreon designs given away are exempt from this rule due to the fact they aren't necessarily 'free'; the owner paid a monthly fee in order to gain the opportunity to own/claim the 'free' adoptable, therefore I don't put restrictions on Patron/subscriber designs I give away/raffle off/etc.Finally, I reserve the right to blacklist anyone from my designs/adoptables should the terms be broken or otherwise mistreated. This being said, if you have me blocked (IP or otherwise) I would prefer that you not purchase my designs; it rubs me the wrong way and while I know this is pretty impossible to keep track of, I've seen it done before and am not a fan for how that settles with me. Doing this does not give you permission nor the right to not give me proper credit or remove my credit to art/a design/work I've done in any way, shape, or form. If you don't want to or are uncomfortable giving me proper credit where it's due, then don't own designs by me.I like to know where my designs are but you are in no way obligated to keep me updated. I just like to see where they go!
◈ Final Agreement ◈
All articles of this Terms of Service Agreement are applicable unless specifically outlined within the final written agreement between Client and Artist.
◈ Acceptance of Agreement ◈
By contacting me for work or purchasing my products (adoptables, attached art to a subject, etc.) you are hereby agreeing to the terms expressed above.
